Anti-discrimination
The Law on Prohibition of Discrimination ("Official Gazette of Bosnia and Herzegovina", no. 59/09 and 66/16) protects the citizens of Bosnia and Herzegovina from discrimination in all areas of life. Discrimination in the sense of this Act is considered to be any different treatment, including any exclusion, restriction or preference based on real or assumed grounds towards any person or group of persons on any basis.
According to the Law on Prohibition of Discrimination, any person or group of persons who are considered to be discriminated against can seek protection of their rights through existing judicial and administrative procedures. Also, he can file a lawsuit to establish the existence of discrimination (a lawsuit to establish discrimination) and request a ban on taking actions that violate or may violate the right to equal treatment.
The burden of proof in the subject of the discussion is on the violator, who is obliged to prove that he did not violate the principle of equal treatment or the prohibition of discrimination.
The central institution for protection against discrimination is the Human Rights Ombudsman of Bosnia and Herzegovina, which is given broad powers by the Law on Prohibition of Discrimination to protect individuals and groups from actions that the Law defines as discriminatory. https://www.ombudsmen.gov.ba/
The competences of the Ministry of Human Rights and Refugees of Bosnia and Herzegovina are prescribed by Article 8 of the Law on Prohibition of Discrimination and are reflected in the fact that the Ministry collects data on the occurrence of discrimination and, based on the collected data, reports to the Council of Ministers of Bosnia and Herzegovina and the Parliamentary Assembly of Bosnia and Herzegovina on the occurrence of discrimination, and proposes legislative or other measures to combat it.
