Religious freedoms

The Ministry of Human Rights and Refugees of Bosnia and Herzegovina has the authority to, on behalf of the bodies of Bosnia and Herzegovina, and in accordance with the Law on Freedom of Religion and the Legal Status of Churches and Religious Communities in Bosnia and Herzegovina ("Official Gazette of Bosnia and Herzegovina, No. 5/04) of January 28, 2004, monitor both the implementation of the aforementioned Law, as well as the promotion and protection of individual and collective human rights, especially the right to freedom of conscience and religion, in accordance with the Constitution of Bosnia and Herzegovina, and the highest international standards of human rights contained in international declarations and conventions on freedom of religion.

The Ministry, as the competent authority for relations with churches and religious communities, is responsible for:

  • participates in the preparation, creation and proposal of the text of basic agreements/contracts concluded between Bosnia and Herzegovina, churches and religious communities;

  • gives an opinion in connection with a case of prohibition or restriction of freedom of religion or belief in cases of violation of the right to freedom of religion, and on the basis of written inquiries/presentations which have been submitted by churches and religious communities, to ask all state, entity, cantonal and municipal authorities to take measures prescribed by law to prevent such violations as stipulated in Article 17 of the Law on Freedom of Religion and the Legal Status of Churches and Religious Communities in BiH.

All important issues regarding freedom of religion, which are of interest to the four traditional churches and religious communities, are resolved in consultation with the BiH Interreligious Council.

CONTRACTS / AGREEMENTS OF THE COUNCIL OF MINISTERS OF BIH

  1. Agreement on mutual cooperation between the Council of Ministers of BiH and the Interreligious Council of BiH signed in 2008, which aims to support its activity in building interreligious dialogue, religious tolerance and coexistence in BiH

  2. The Basic Agreement between Bosnia and Herzegovina and the Holy See and the Additional Protocol to the Basic Agreement were ratified in 2007 by the Presidency of Bosnia and Herzegovina, and in 2008 the Joint Commission was established to monitor the implementation of this agreement;

  3. The basic agreement between the Serbian Orthodox Church and Bosnia and Herzegovina was ratified in May 2008 by the Presidency of Bosnia and Herzegovina, and in 2010 the Joint Commission was established to monitor the implementation of this agreement;

On the same basis, the draft of the Agreement between Bosnia and Herzegovina and the Islamic Community in Bosnia and Herzegovina was prepared. The Council of Ministers of Bosnia and Herzegovina held its 25th session on September 29, 2015. established the proposal for a Basic Agreement between Bosnia and Herzegovina and the Islamic Community in Bosnia and Herzegovina.
